Terms and Conditions

These Terms govern your use of the BirthBot text-message service and website ("the Service"), provided by BirthX, doing business as BirthBot ("we", "us"). By signing up, you agree to these Terms and to our Privacy Policy.

1. The Service

BirthBot sends short educational text messages about pregnancy, birth and the first weeks with a new baby, matched to how far along the pregnancy is. You can also text us commands (such as MENU, TIME, DAYS, PAUSE, BORN), ask questions, and look up hospital information. The program runs through the pregnancy and about 12 weeks after birth.

2. Text message program

• Program: BirthBot pregnancy and new-baby tips.
• Frequency: recurring messages based on the schedule you choose (from once a week up to daily), plus follow-up questions and replies to your texts. We only text between 5am and 11pm in your time zone.
• Cost: message and data rates may apply, according to your mobile plan.
• Help: reply HELP for help, or email hello@birthx.org.
• Opt out: reply STOP at any time to stop all messages. You will receive one message confirming you have opted out. Reply START to join again.
• Mobile carriers are not liable for delayed or undelivered messages.
• You agree that the phone number you provide is yours, or that you are authorized to use it.

3. Subscription and payment

• The Service is a paid subscription ($3.99 a week). The price is shown before you pay. Payments are processed by Stripe.
• Your subscription renews automatically each billing period until it ends or is cancelled.
• Automatic end: your subscription is cancelled automatically when your program is finished, so you are not charged after that.
• Cancelling: you can cancel any time from your settings page (text SETTINGS for a link). When you cancel, or reply STOP, your subscription ends at the close of the period you have already paid for, and you are not charged again.
• We do not give refunds for partial billing periods, except where required by law.
• If a payment fails, we may pause the Service until your payment details are updated.
• We may change prices with advance notice. Changes apply from your next billing period.

4. Not medical advice

BirthBot is for general education only. It is not medical advice, diagnosis or treatment, and it does not replace care from your doctor, midwife or other healthcare provider. Always ask your provider about your own health and your baby's health. In an emergency, call 911. If you are thinking about harming yourself, call or text 988.

Answers to questions may be generated by an AI system and can be incomplete or wrong. Hospital information is provided as-is from public or third-party sources and may be out of date.

5. Eligibility and your responsibilities

• You must be at least 18 years old, or have permission from a parent or guardian, to use the Service.
• Please give accurate information so we can send tips that fit your stage.
• Do not misuse the Service, send harmful content, or try to access other people's information or our systems.

6. Our content

The tips, guides and other materials we send belong to us or our licensors. You may use them for your own personal, non-commercial use.

7. Changes and ending the Service

We may change or stop parts of the Service, or suspend accounts that misuse it. We may update these Terms; if we make important changes, we will post them here and update the effective date. Continuing to use the Service means you accept the updated Terms.

8. Limitation of liability

The Service is provided "as is." To the fullest extent allowed by law, we are not liable for indirect or consequential damages, or for decisions made based on information from the Service. Our total liability to you is limited to the amount you paid us in the three months before the claim.

9. Governing law

These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-law rules.
